Terms-and-Conditions

None of the below terms and conditions apply when checking availability of dresses.

Ballroom Dress Try Ons:

Rhythmic Rentals, L.L.C. (Rhythmic Rentals) hereby loans to the person or organization who is identified as the Customer, and Customer hereby borrows from Rhythmic Rentals, the Dress(es) selected for Try On on the terms and conditions set forth herein for the time period indicated in email correspondence sent to Customer. Customer shall ship Dress(es) back to Rhythmic Rentals in good condition and with no damages no later than the date specified in email correspondence sent to Customer, or given in the return instructions included in the dress shipment.

Dress(es) are to be worn for modeling purposes only and not to be danced in. If it is determined by Rhythmic Rentals that Dress(es) have been danced in, Customer will be charged full Rental fee of Dress(es).

Try-On Fees: Customer will be charged a $10 handling fee (per dress), Shipping Fees and Taxes (if applicable) at the time of Try On submission.

Ballroom Dress Rentals:

Rhythmic Rentals hereby leases to the Customer, and Customer hereby rents from Rhythmic Rentals, the Dress(es) selected for Rent on the terms and conditions set forth herein for the time period indicated in email correspondence sent to Customer. Customer shall ship Dress(es) back to Rhythmic Rentals in good condition and with no damages no later than the date specified in email correspondence sent to Customer or given in the return instructions included in the dress shipment.

Rental Fees: Customer will be charged the Rental Fees, Shipping Fees and Taxes (if applicable) at the time of Rental submission.

Rental Cancellation: IF DRESS RENTAL CANCELLATION OCCURS MORE THAN THIRTY (30) DAYS FROM RENTAL START DATE, AS SPECIFIED IN EMAIL CORRESPONDENCE, CUSTOMER WILL BE REFUNDED 75% OF RENTAL FEE (AND ASSOCIATED TAXES). 100% OF SHIPPING FEES WILL ALSO BE REFUNDED. IF DRESS RENTAL CANCELLATION OCCURS LESS OR EQUAL THAN THIRTY (30) DAYS FROM RENTAL START DATE, AS SPECIFIED IN EMAIL CORRESPONDENCE, CUSTOMER WILL BE REFUNDED 100% OF SHIPPING FEES ASSUMING DRESSES HAVE NOT BEEN SHIPPED.

Rental Cancellation Insurance: If Customer has purchased insurance and cancellation occurs less or equal than thirty (30) days from Rental Start Date, as specified in email correspondence, Customer will receive a 75% dress rental credit to be used toward future dress rental. This credit must be used within 12 months of original Rental Start Date. Cost is $20 PER DRESS. 

Ballroom Dress Sales:

Rhythmic Rentals hereby sells to the Customer, and Customer hereby buys from Rhythmic Rentals, the Dress(es) selected for purchase on the terms and conditions set forth herein. CUSTOMER ACKNOWLEDGES THAT ALL SALES ARE FINAL WITH NO REFUNDS OR EXCHANGES. 

Purchase Fees: Customer will be charged the Purchase price, Shipping Fees and Taxes (if applicable) at the time of Purchase submission.

Dancewear and Accessories Sales:

Rhythmic Rentals hereby sells to the Customer, and Customer hereby buys from Rhythmic Rentals, the Dancewear and/or Accessories selected for purchase on the terms and conditions set forth herein.

Purchase Fees: Customer will be charged the Purchase price, Shipping Fees (if applicable) and Taxes (if applicable) at the time of Purchase submission.

Returns: 5 day return policy. If 5 days have gone by since you received your purchase, unfortunately we can’t offer you a refund or exchange. To be eligible for a return, your item must be unused and in the same condition that you received it. It must also be in the original packaging.

Refunds: Once your return is received and inspected, we will send you an email to notify you that we have received your returned item. We will also notify you of the approval or rejection of your refund. If you are approved, then your refund will be processed, and a credit will be applied to your credit card or original method of payment. Our shipping cost will be deducted from your refund along with a 15% restocking fee.

Shipping: Shipping is free within continental United States. Rhythmic Rentals is not responsible for packages once delivery has been confirmed by the carrier.


Shipping Returns: To return your product, you should mail your product to: 4108 Tansley Ct Greensboro North Carolina US 27407.
You will be responsible for paying for your own shipping costs for returning your item. If you receive a refund, our shipping cost will be deducted from your refund along with a 15% restocking fee.

 

Additional Terms (Ballroom Dress Try Ons and Ballroom Dress Rentals):

  1. Late Return Fee: If Customer fails to ship the Dress(es) back to Rhythmic Rentals by the date specified in email correspondence or given in the return instructions included in the dress shipment, Customer hereby authorizes Rhythmic Rentals to charge Customer the Rental Fee for non-returned Dress(es) as a Late Return Fee, and an equal amount every day thereafter until the non-returned Dress(es) are returned (amount not to exceed 15 (fifteen) times the Rental Fee for each non-returned Dress(es)).
  2. Failure to Return Fee: If Customer fails to return the Dress(es) within 10 (ten) days of the date specified in the email correspondence or given in the return instructions included in the dress shipment, then Customer hereby authorizes Rhythmic Rentals to charge Customer 15 (fifteen) times the Rental Fee for each non-returned Dress. A Late Fee will not be charged if the Failure to Return Fee is charged.
  3. Liquidation Damages: Customer acknowledges and agrees that it would be difficult to establish an accurate value for the Dress(es) in the event the Dress(es) is/are damaged, lost, stolen or destroyed (liquidated damages). Customer agrees that 15 (fifteen) times the Rental Fee for each item is a reasonable estimate of such value. Customer hereby authorizes Rhythmic Rentals to charge Customer this amount as the amount to be paid by Customer as liquidated damages. Such amount is intended to represent liquidated damages and not a penalty.
  4. Loss or Damage: CUSTOMER IS SOLELY RESPONSIBLE FOR THE SAFE CARE AND RETURN OF THE DRESS(ES) IN GOOD CONDITION, AND CUSTOMER SHALL BEAR THE ENTIRE RISK OF LOSS OR DAMAGE TO THE DRESS(ES). PRO TAN OR ANY SIMILAR PERMANENT TANNING PRODUCTS ARE NOT PERMITTED. These products will not come out if not washed immediately. If dress(es) are returned with permanent tanning stains, the Customer will be responsible for any costs required to repair the dress up to the entire retail price of the dress (or fifteen (15) times the Rental Fee, whichever is more).
  5. Title to Dress(es): The Dress(es) shall remain the exclusive property of Rhythmic Rentals. Customer shall have no rights whatsoever in or to the Dress(es) other than its rental in accordance with the terms stated herein.

Additional Terms (Ballroom Dress Try Ons, Ballroom Dress Rentals and Ballroom Dress Purchases):

  1. Shipping Fees: Rhythmic Rentals uses FedEx for all shipping and Customer will be charged all shipping fees and Taxes (if applicable) related to shipping to and from Customer of Dress(es).
  2. Late Payment Fee: If Customer fails to make complete payment on time, as specified in this agreement, Rhythmic Rentals reserves the right to charge a Late Payment Fee of $10 per day until balance is paid in full.
  3. Credit Card Processing Fee: If Customer's credit card is invalid or declined Rhythmic Rentals reserves the right to charge a $10 processing fee for each occurrence.
  4. Attorney’s Fees & Court Costs: Reasonable attorney’s fees and court costs incurred in the collection of any amount due from Customer to Rhythmic Rentals will be charged to Customer.
  5. Credit: In Customer correspondence, Customer has provided credit card information to Rhythmic Rentals as security for the performance to Customer's obligations hereunder. Rhythmic Rentals will not knowingly share this information with any outside party.
  6. Acceptance of Dress(es): Customer agrees to accept the Dress(es) “as is”. CUSTOMER ACKNOWLEDGES THAT RHYTHMIC RENTALS HAS NOT AND DOES NOT MAKE ANY REPRESENTATIONS OR WARRANTIES OF ANY KIND OR NATURE, DIRECTLY OR INDIRECTLY, EXPRESS OR IMPLIED, AS TO ANY MATTER WHATSOEVER, INCLUDING THE SUITABILITY OF THE DRESS(ES), ITS FITNESS FOR ANY PARTICULAR PURPOSE, ITS MERCHANTABILITY, ITS CONDITION AND/OR ITS QUALITY. Rhythmic Rentals assumes no liability under this Agreement, including without limitation failure of delivery of the Dress(es). Rhythmic Rentals shall not have any liability for special, incidental or consequential damages arising out of or in connection with the rental or use of the Dress(es).
  7. Indemnification: Customer agrees to exculpate and indemnify Rhythmic Rentals, it’s officers, employees and agents, from and against any and all losses, injuries, claims, demands and expenses of any nature arising out of this contract or out of the rental or use of the Dress(es), whether arising out of contract, tort, product liability or any other cause of action.
  8. Refund Liability Waiver: Rhythmic Rentals cannot be held liable for improper fit of Dress(es) for any reason whatsoever.
  9. Miscellaneous: These Terms & Conditions and any policies, operating rules or other Terms of Service posted by us on this site or in respect to the Service constitutes the entire agreement and understanding between you and us.
  10. These terms and conditions are governed by the laws of the State of North Carolina.
